Welcome to NoseBleed. These Terms of Service ("Terms") govern your use of the NoseBleed mobile application (the "App") and any related services. By creating an account or using the App, you agree to these Terms. If you don't agree, please don't use the App.

NoseBleed is operated by Mark Angelo Baricante, a sole proprietor based in the Philippines ("we," "us," or "our"). Contact: support@nosebleed.app.

1. Eligibility

You must be at least 13 years old to use NoseBleed (and at least the age of digital consent in your country — typically 16 in the European Economic Area). By using the App you represent that you meet this requirement.

If you are under the age of majority in your jurisdiction, you must have your parent or legal guardian's permission to use the App.

2. The Service

NoseBleed is a speaking-practice app. You spin a wheel to receive a random topic, record a short video of yourself speaking about it, and watch the recording back to improve your speaking habits over time. We may add, change, or remove features at any time.

The App requires an Apple or Google account to sign in. Your recordings are stored locally on your device.

3. Your Account

You're responsible for keeping your account secure. Don't share your sign-in credentials. You're responsible for everything that happens under your account.

You can permanently delete your account at any time via Settings → Delete Account in the App. This is irreversible — your account, profile, and on-device recordings will be wiped.

We may suspend or terminate your account if you violate these Terms (see Section 8).

4. Subscriptions (NoseBleed Pro)

NoseBleed offers an auto-renewing subscription ("NoseBleed Pro") that unlocks the full app experience.

4.1 Available plans

A limited-time introductory offer of USD $1.99 for the first week may be available to new subscribers on the Weekly plan. After the intro period, the subscription auto-renews at the standard Weekly price above.

Prices in other countries are set by Apple based on the equivalent App Store price tier and may vary.

4.2 Auto-renewal disclosure (Apple-required)

• Payment is charged to your Apple ID at confirmation of purchase.
• Auto-renewal: your subscription automatically renews unless you cancel it at least 24 hours before the end of the current period.
• Renewal charge is taken from your account within 24 hours prior to the end of the current period.
• Manage your subscription at any time in iOS Settings → [your name] → Subscriptions. You can also turn off auto-renewal there.
• Cancellation: cancelling stops future renewals. You'll keep access to NoseBleed Pro for the remainder of the period you've already paid for. We do not provide refunds for unused portions of a billing period.

4.3 Refunds

All purchases are made through Apple's App Store. Refund requests are handled by Apple under their refund policy: apple.com/legal/internet-services/itunes/.

4.4 Account deletion does not cancel your subscription

Deleting your NoseBleed account through the App does not cancel your Apple subscription. To stop being charged, cancel the subscription separately in iOS Settings → Apple ID → Subscriptions.

5. Your Content

Your recordings are yours. We do not own them, we do not view them, and we do not upload them to our servers. They are stored on your device.

You are responsible for what you record. By using the App you agree not to record content that:

• Violates any law
• Infringes another person's rights (privacy, intellectual property, etc.)
• Contains hate speech, harassment, or threats
• Is sexually explicit or otherwise inappropriate
• Promotes self-harm or violence

Even though your recordings stay on your device, these rules apply to anything you share out of the App.

6. Acceptable Use

You agree not to:

• Reverse engineer, decompile, or attempt to extract the App's source code
• Use the App to harass, abuse, or harm others
• Attempt to interfere with or disrupt the App or its servers
• Bypass or attempt to bypass our paywall or subscription system
• Use the App in any way that violates applicable law or these Terms
• Resell, sublicense, or commercially exploit the App without our written permission

7. Intellectual Property

The NoseBleed name, logo, app design, prompts, topic library, and all related content (other than your own recordings) are owned by us and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes — that license ends if you stop using the App or if we terminate your access.

8. Termination

You can stop using the App at any time. You can permanently delete your account via the App at any time.

We may suspend or terminate your access if you violate these Terms, abuse the service, or attempt to defraud us or other users. We'll usually warn you first when feasible.

If your account is terminated, sections of these Terms that by their nature should survive (intellectual property, disclaimers, limitations of liability, governing law) will continue to apply.

9. Disclaimers

NoseBleed is provided "as is" and "as available", without warranties of any kind, express or implied. We do not warrant that the App will be uninterrupted, error-free, or that it will help you achieve any particular outcome.

We do not guarantee that NoseBleed will improve your speaking skills, help you pass any exam (IELTS, TOEFL, Cambridge, TOEIC, etc.), or produce any specific result. Speaking improvement depends on practice, and that's on you.

10. Limitation of Liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the App, even if we have been advised of the possibility.

Our total liability for any claim related to the App is limited to the greater of (a) the amount you have paid us in the 12 months preceding the claim, or (b) USD $50.

Some jurisdictions don't allow these limitations, so they may not apply to you.

11. Indemnification

You agree to indemnify and hold us harmless from any claims, losses, or damages (including reasonable legal fees) arising from your use of the App, your content, or your violation of these Terms.

12. Governing Law

These Terms are governed by the laws of the Republic of the Philippines, without regard to its conflict-of-law provisions. Any dispute arising from these Terms shall be brought exclusively in the courts of the Philippines, unless your local consumer-protection laws require otherwise.

13. Changes to These Terms

We may update these Terms from time to time. When we do, we'll revise the "Last updated" date at the top. For material changes, we'll provide additional notice (in-app message or email). Continued use of the App after a change indicates your acceptance.

14. Apple-Specific Terms

You acknowledge that these Terms are between you and us, not between you and Apple. Apple has no obligation to provide any maintenance or support for the App. In the event of a third-party claim that the App infringes intellectual property, we (not Apple) are responsible. Apple is a third-party beneficiary of these Terms and may enforce them against you.
